What laws prevent the gas driller from dumping drilling mud and fracking fluid into the nearest stream? What are the penalties for doing so?

In Pennsylvania, the Clean Streams Law prevents the unlawful discharge of any fluids into surface waters. The federal Clean Water Act also prevents such actions. If an individual or entity is found to be in violation of either law, they can, and should be prosecuted criminally and civilly.
